1. About Lolty

Lolty ("we", "us", "our") is a digital loyalty card platform that enables independent businesses to create and manage branded loyalty cards delivered via Apple Wallet and Google Wallet. By using Lolty, you agree to these Terms of Service.

2. Eligibility

You must be at least 18 years old to create a business account. By creating an account, you confirm that all information you provide is accurate and that you are authorised to act on behalf of any business you register.

3. Pilot programme

Lolty is currently in a pilot phase. During this period:

  • The Pro plan is provided free of charge with no credit card required
  • There is no automatic billing — you will be contacted directly before any paid plan begins
  • Features and limits may change during the pilot
  • We reserve the right to end the pilot with reasonable notice

Your data remains yours regardless of what happens with the pilot.

4. Acceptable use

You agree not to use Lolty to:

  • Violate any applicable laws or regulations
  • Send spam or unsolicited communications to customers
  • Upload content that is fraudulent, misleading, or violates third-party rights
  • Attempt to reverse-engineer, scrape, or disrupt the platform
  • Collect data from customers beyond what is disclosed to them

5. Intellectual property

You retain ownership of your brand assets (logo, colours, business name) uploaded to Lolty. By uploading them, you grant us a limited licence to display them within the platform and on loyalty cards issued to your customers.

Lolty's software, design, and brand remain our intellectual property.

6. Customer data responsibilities

As a business using Lolty, you are a data controller for the customer data collected through your loyalty programme. You are responsible for:

  • Informing your customers about how their data is used
  • Complying with applicable data protection laws (including GDPR if operating in the EU/EEA)
  • Not using customer data for purposes beyond loyalty programme management

7. Service availability

We aim to keep Lolty available at all times but cannot guarantee uninterrupted service. We are not liable for losses caused by downtime, technical errors, or events outside our control.

8. Termination

You can close your account at any time by contacting us at [email protected]. We may suspend or terminate accounts that violate these terms, with notice where possible.

9. Limitation of liability

To the maximum extent permitted by law, Lolty's liability for any claim related to the service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

10. Governing law

These terms are governed by the laws of Spain. Any disputes will be resolved in the courts of Spain, unless applicable consumer law in your country provides otherwise.

11. Changes to these terms

We may update these terms from time to time. If we make material changes, we will notify registered users by email at least 30 days before they take effect. Continued use of the service after that date constitutes acceptance of the new terms.
